1. Acceptance of these Terms
By accessing or using GoSafe, creating an account, booking a service, sending a parcel, joining as a driver or partner, registering a school, creating an event code or using a pickup point, you agree to these Terms and our Privacy Policy. If you do not agree, do not use GoSafe.
2. What GoSafe provides
GoSafe is a technology and mobility platform that connects customers and organizations with transport and logistics providers. Services may include taxi rides, executive vehicles, bikes, e-bikes, parcel delivery, pickup points, school transport, event transport, club drop-offs, hospital runs and emergency movement support.
Unless expressly stated otherwise in a written contract, independent drivers, delivery partners, fleet owners, schools, venues, pickup points and event partners are responsible for delivering their respective services safely, lawfully and professionally.
3. Accounts and eligibility
- You must provide accurate information and keep your account secure.
- You are responsible for activity under your account unless caused by GoSafe's proven negligence.
- You must not share OTPs, passwords or driver/customer account access with unauthorized persons.
- Customers must be legally capable of entering contracts, or use GoSafe through a parent, guardian, school or authorized organization.
- Drivers and delivery partners must meet all legal, licensing, vehicle, insurance, tax and safety requirements applicable in Kenya.
4. Customer responsibilities
- Use GoSafe only for lawful trips, deliveries and service requests.
- Provide correct pickup, destination, contact and parcel details.
- Respect drivers, riders, school staff, venue staff, pickup point agents and other users.
- Pay fares, delivery fees, waiting charges, cancellation fees, tolls, parking or other disclosed charges.
- Do not damage vehicles, abuse partners, harass others, create false bookings or misuse emergency features.
5. Driver, rider and fleet partner responsibilities
- Maintain valid licences, insurance, vehicle fitness, roadworthy vehicles and required approvals.
- Comply with the Traffic Act, NTSA requirements, PSV rules where applicable, county rules and platform safety standards.
- Follow assigned routes, complete trips honestly and never manipulate fares, GPS, parcel status or event access.
- Treat customers, students, parents, event guests and parcel recipients professionally.
- Report accidents, incidents, emergencies, unsafe parcels, disputes and law enforcement requests promptly.
6. School transport terms
- Schools, parents or guardians must provide accurate student, route, pickup, drop-off and authorized contact details.
- Student transport must be handled only by authorized partners and vehicles approved for that arrangement.
- Parents, guardians and schools are responsible for ensuring children are ready for pickup and received by authorized persons.
- GoSafe may suspend school transport arrangements where safety, identity, route or payment concerns arise.
7. Parcel delivery terms
You must not send prohibited, illegal, unsafe or restricted items, including:
- Weapons, ammunition, explosives, flammable goods or dangerous chemicals.
- Illegal drugs, counterfeit goods, stolen goods or items prohibited by Kenyan law.
- Cash, high-value jewellery, live animals, human remains, hazardous medical waste or fragile goods not properly packed.
- Items requiring special licences, cold-chain handling or regulatory approvals unless GoSafe has expressly accepted them in writing.
Parcel senders are responsible for lawful ownership, accurate descriptions, secure packaging and recipient availability. GoSafe may refuse, cancel, inspect or report a parcel where required for safety, legal compliance or fraud prevention.
8. Event codes, clubs and venue transport
- Event organizers are responsible for issuing codes only to authorized guests, staff or participants.
- Clubs, venues and event partners must provide safe pickup points and cooperate with lawful safety procedures.
- GoSafe may deactivate an event code if it is abused, shared publicly, used for fraud, connected to unsafe conduct or not paid for.
- Guest transport remains subject to driver availability, road conditions, weather, security and applicable law.
9. Hospitals and emergencies
GoSafe may support urgent movement to hospitals or emergency destinations, but GoSafe is not an ambulance service, medical provider or emergency response authority unless expressly contracted and licensed for such a service. In life-threatening emergencies, contact official emergency services first.
10. Pricing, payment and refunds
- Fares may depend on distance, time, service type, vehicle category, demand, waiting time, tolls, parking, parcel size or partner agreement.
- Prices shown before booking are estimates unless marked as fixed.
- Payment may be made by mobile money, wallet, card, cash or approved corporate/school/event billing methods.
- Refunds may be issued where required by law, platform policy or confirmed service failure.
- Chargebacks, false disputes, unpaid balances or payment abuse may lead to account suspension.
11. Cancellations and delays
Customers and partners should cancel only when necessary. Cancellation fees may apply where a driver, rider, school vehicle or event vehicle has already accepted or arrived. GoSafe is not liable for delays caused by traffic, weather, road closures, police checks, accidents, riots, network outages, force majeure, security incidents or incorrect user information.
12. Safety, conduct and suspension
GoSafe may suspend, restrict or terminate access where a user or partner:
- Breaks these Terms, law or safety policies.
- Threatens, harasses, abuses, discriminates against or endangers another person.
- Submits false identity, vehicle, school, event, parcel or payment information.
- Misuses location tracking, event codes, emergency tools, pickup points or support channels.
- Damages property, commits fraud, manipulates trips or harms the GoSafe brand.
13. Intellectual property
The GoSafe name, logos, website, app, content, designs, software, service names and brand assets belong to GoSafe or its licensors. You may not copy, misuse, resell, reverse engineer, scrape or exploit GoSafe content or technology without written permission.
14. Data protection
Personal data is handled under our Privacy Policy, the Data Protection Act, 2019 and applicable Kenyan regulations. By using GoSafe, you agree that we may process data needed for bookings, payments, safety, support, partner management, school transport, parcel tracking, event codes, legal compliance and fraud prevention.
15. Limitation of liability
To the fullest extent allowed by Kenyan law, GoSafe is not liable for indirect, incidental, special, punitive or consequential losses, including lost profits, lost opportunity, missed events, lost data or reputational loss. GoSafe's liability for a direct claim is limited to the amount paid for the specific service giving rise to the claim, unless Kenyan law requires a higher remedy.
16. Indemnity
You agree to indemnify GoSafe, its officers, employees, agents and partners against claims, losses, penalties, costs and expenses arising from your breach of these Terms, unlawful conduct, misuse of the platform, false information, unsafe parcel contents, vehicle non-compliance or violation of another person's rights.
17. Disputes and governing law
These Terms are governed by the laws of Kenya. Parties should first attempt to resolve disputes through GoSafe support. If unresolved, disputes may be referred to mediation, arbitration or the courts of competent jurisdiction in Kenya, depending on the nature of the claim and applicable law.
18. Changes to these Terms
We may update these Terms from time to time. The latest version will be posted on this website. Continued use of GoSafe after changes means you accept the updated Terms.
